MANILA - The Supreme Court on Monday stopped the government from signing a land deal with Muslim separatist rebels, in yet another setback to efforts to end more than 30 years of deadly insurgency. The ruling was in response to a petition filed by officials in the southern Philippines who oppose the signing on Tuesday of an agreement between the Moro Islamic Liberation Front (MILF) and the government. The planned deal had sparked massive street protests in the country's south amid fears that non-Muslim areas could be covered under the deal giving the MILF control over large swathes of lands in southern Mindanao island."The court issued a TRO (temporary restraining order) restraining the respondents from signing the MOA (memorandum of agreement)," court spokesman Midas Marquez told reporters in Manila. The agreement would give MILF powers over an autonomous area that would have its own legal, banking and education systems, civil service and internal security force, and had been seen as paving the way for a formal peace deal with the rebels. MILF spokesman Eid Kabalu called the decision a "setback," but he said the 12,000-strong group remained "committed to solving the problem peacefully."Kabalu said MILF peace negotiators have yet to formally receive the Supreme Court order, although presidential spokesman Jess Dureza said Tuesday's signing ceremony in Malaysia would not take place. "We submit to the sound discretion of the (court), which is the ultimate arbiter of issues and so effectively the signing of the agreement will have to be cancelled," Dureza said.The court ordered the government to submit a draft of the agreement later this week, and defend its merits in oral arguments on August 15. Dureza said Arroyo was confident the court will eventually "uphold the position" of the government and lift all obstacles to ending MILF's insurgency, which began in 1978.Congressman Erico Fabian, who had filed the petition against the deal, said the ruling was "very good news for our people down south" who opposed the draft accord.

ZAMBOANGA CITY, Philippines (Mindanao Examiner / August 6, 2008) - The Moro National Liberation Front (MNLF) has accused Manila on Wednesday of failing to implement the peace agreement it signed with the former Muslim rebel group more than a decade ago. "We want freedom from the government. We don't need a limited freedom," Nur Misuari, leader of the MNLF who signed the peace deal in 1996, said in Zamboanga City where he met with about 200 former rebels and supporters, some from as far as Davao del Sur province. "I have gone to all of the most dangerous places in Mindanao to tell our people to pray to almighty Allah for freedom. I call on our people to consolidate their unity and solidarity for freedom," he said. Misuari, escorted by former rebels-turned-government soldiers, and supporters chanted "Allahu Akbar" or God is great, as they marched to the village. Security was tight for Misuari and Muslims entering the mosque to pray were frisked by soldiers for weapons.

The poor and the middle class who probably expected that some measure of relief would be announced by Mrs. Gloria Macapagal-Arroyo during her State of the Nation Address (SONA) last July 28 may have been disappointed. A substantial portion of President Arroyo's SONA was devoted to defending the administration's insistence in retaining the value-added tax (VAT) on oil and power. Arroyo said, "Kapag ibinasura ang VAT sa langis at kuryente, ang mas makikinabang ay ang mga may kaya na kumukonsumo ng 84 porsyento ng langis at 90 porsyento ng kuryente habang mas masasaktan ang mahihirap na mawawalan ng P80 billion para sa mga programang pinopondohan ngayon ng VAT. Take away VAT and we strip our people of the means to ride out the world food and energy crisis." (If the VAT on oil and power is scrapped, the well-to-do who consume 84 percent of oil and 90 percent of power will benefit while the poor who stand to lose P80 billion [$1,808,931,599 at an exchange rate of $1=P44.225] for programs funded by VAT will suffer.) The settlers have been blamed for waves of crime and creating a generation of stateless children who live in appalling conditions in the towns and villages of Sabah state. The influx of mostly Muslim migrants has also tipped the ethnic balance against indigenous tribes who used to dominate the population, say politicians in Sabah, which is struggling to cope with the influx. After a poor result in March elections that made it more sensitive to voter gripes, the national government has announced a mass crackdown to send the illegal migrants back to their home countries.

A Bangsamoro state bereft of respect for civil and human rights will be formed once the memorandum of agreement (MoA) on ancestral domain between the government and the Moro Islamic Liberation Front (MILF) is signed and becomes executory, an administration lawmaker has warned. In a privilege speech that he entered into the House records late on Monday, Makati Rep. Teodoro Locsin said the would-be Bangsamoro homeland rising from the proposed expanded Autonomous Region in Muslim Mindanao "shall exercise absolute political powers." "Indeed, it shall possess absolute powers without any prohibition against the discrimination, abuse and enslavement of women which happens in some Muslim states," said Locsin, who chairs the House committee on suffrage.
